All depending on your wheel backspacing.

Using the stock wheels ??

I went through this. I run 35-12.5 BFG muds on stock 2012 COD rims. Lots of internet chatter said they would rub, so I bought some 1.25" spacers and ran them. During a tire rotation, I took them off and ran the setup without them to see what would happen. That was 3 years ago and my spacers are still on a shelf in the garage and I haven't once rubbed the rears. I should also mention that my upper rear control arms have a bend in them to give the rear tires just a little bit more room to move around, but I don't remember rubbing on the stock control arms either.

My front tires rub on my sway bar if I'm at full crank during a u-turn. Easy enough for me to just back off the steering wheel a bit.

I put 35 s on the stock Rubicon rims and used spacers to prevent rub.

His dealer likely told him that you cant put 35"/37" on the factory wheel, so in his mind.... and I'm betting that he thought it was evident that by saying 35" tires were coming, that as any fool would know.... you simply have to buy wheels.

Little did he know that he was one being played the fool!
